These Terms govern your user account, your use of talk+, and ending your use of the platform. For talk+ purchases, our Right of Withdrawal notice additionally applies; for profiles, calls, and meetings, our Community Guidelines additionally apply; for data processing, see our Privacy Policy.
These Terms govern the use of the talkbeforedate platform between the provider (see Imprint) and registered users. The service is intended exclusively for consumers aged 18 or over; commercial use is not provided for.
talkbeforedate is a dating platform enabling anonymous calls through the app — without exchanging phone numbers. The platform does not guarantee meetings or relationships and does not act as a matchmaking agency in the legal sense.
The platform is continuously being developed; individual features may be changed, restricted, or discontinued at any time, and uninterrupted operation is not guaranteed. There is no entitlement to the permanent provision of any particular feature.
Using the service requires registration with a valid email address. Requirements:
Only one account/profile per person is allowed. Login credentials must be kept confidential.
Registration is free and creates a user-account/platform relationship, not a paid contract — a right of withdrawal under § 355 BGB does not apply to it. A right of withdrawal exists exclusively for paid contracts (talk+); details are governed by the Right of Withdrawal notice. You can delete your account free of charge at any time (§ 9); deletion of your data follows our Privacy Policy.
Our Community Guidelines, which form part of these Terms, govern profiles, conduct in chat/calls, and how reports are handled. In particular, the following is prohibited:
Violations may, depending on severity, result in a warning, feature restrictions, or immediate suspension of the account.
The provider is entitled to moderate content and, in particular, to remove offensive, defamatory, or discriminatory content, or content inciting unlawful acts, immediately and without prior notice. Unlawful content may be reported to the competent authorities and referred for prosecution.
We will inform you of moderation decisions affecting your content or account (e.g. removal, restriction, suspension), stating the material reasons, to the extent Regulation (EU) 2022/2065 (DSA) requires this. You may object to such a decision informally via the point of contact named in the Imprint; we will then review the case again.
Users are solely responsible for their profile information, content, and actions. The provider does not adopt user-submitted (third-party) content as its own.
You retain all rights to the photos and content you upload. You grant us a simple, non-exclusive licence, limited to the duration of your account, to store and process your content within the platform (e.g. scaling, cropping, automated photo and verification checks) and to display it to other users according to your visibility settings. This licence ends when the relevant content or your account is deleted, subject to statutory retention obligations or ongoing report/moderation proceedings.
You represent that you hold the necessary rights to your uploaded content and that it does not infringe any third-party rights.
Profile photos and verification selfies may be automatically pre-screened by an AI model (see Community Guidelines). This check is a supporting suggestion only — granting or revoking verification status is always decided by a human member of our team. A verification badge is not a guarantee of a user's actual identity or of the truthfulness of all profile information.
After a match, calls are free for all users and are not tied to any paid product. Additional features and more reach — such as more simultaneously active conversations, advanced filters, or priority reading of your requests — can be unlocked via a talk+ subscription.
talk+ subscription: talk+ is taken out with either a monthly or annual term; the prices shown in the app at the time of purchase apply. The monthly plan renews automatically for one further month unless it is cancelled. The annual plan ends automatically after twelve months and does not renew; a continuation is only possible if you actively re-book or confirm it before it expires. You can cancel a running subscription at any time — up to the last day of the current billing period — online via the "Manage subscription" button in Settings (Stripe customer portal, § 312k BGB), or without logging in via our cancellation page (labelled "Cancel contracts here"); cancellation takes effect at the end of the current billing period, and talk+ remains usable until then. Amounts already paid for the current period are not refunded on a pro-rata basis. We give timely notice of any price changes for future billing periods in accordance with § 10.
talk+ cannot be transferred to other accounts; cash payout is excluded. If you delete your account yourself, any running talk+ subscription also ends; amounts already paid for the current billing period are not refunded on a pro-rata basis. If your account is permanently suspended or deleted due to a serious, repeated, or unlawful violation of § 4, talk+ may be terminated with immediate effect; amounts already paid for the current billing period are not refunded only to the extent that the violation justifies the termination and exclusion from further use and this is legally permissible. Your statutory right of withdrawal remains unaffected by this. In the event of a successful chargeback or withdrawal of a talk+ payment, the corresponding activation is reversed, to the extent legally permissible and appropriate in the individual case.
During a beta phase, talk+ may be provided free of charge; there is no entitlement to permanent free provision. Prices in EUR including VAT. Payments processed by Stripe. Your 14-day right of withdrawal for talk+ purchases, and the consequences of immediate start (proportionate value compensation under § 357(8) BGB), are governed by the Right of Withdrawal notice.
We provide the technical platform for anonymous calls and contact; we are not a party to conversations or meetings between users and cannot review their content in advance. If we become aware of unlawful content or a violation of our Community Guidelines (e.g. through a report), we review the matter and remove content or suspend accounts to the extent the violation justifies it (notice-and-takedown).
We are not liable for:
In particular, we give no warranty as to the accuracy of profile information, the presence or significance of verification badges, or the actual identity of other users. We require confirmation of being of legal age at registration and act on concrete indications of a user being a minor; a seamless age verification is, however, technically impossible, which is why we give no warranty as to other users' compliance with the minimum age requirement. Exercise your own due care when making contact and meeting.
Indemnification: The user shall indemnify the provider against third-party claims asserted on the basis of unlawful content or unlawful use of the platform by the user, to the extent the user is responsible for the infringement. This also includes the reasonable costs of necessary legal defence.
Statutory liability for intent, gross negligence, damages arising from injury to life, body or health, and under the Product Liability Act remains unaffected.
Users can delete their account at any time, free of charge, via the app settings. Termination can also be declared informally by email (contact: see Imprint). Upon deletion you lose access to your matches and chat histories; these are deleted in accordance with the Privacy Policy.

The provider may suspend or delete accounts without prior notice in case of violations of these Terms or the Community Guidelines, where the severity of the violation justifies it.
Dormant and inactive accounts: Accounts not used for more than six months may be marked as inactive. If an account is not used for an uninterrupted period of 24 months, the provider is entitled to delete it. Before such deletion, we will notify you once by email at least 30 days in advance, so that you can retain your account by logging in. Statutory retention obligations and ongoing report or moderation proceedings remain unaffected.
Changes to these Terms apply prospectively only and do not affect contracts already concluded. A running talk+ subscription remains governed by the terms agreed at the start of the contract until the end of the paid billing period, unless statutory requirements necessitate an adjustment.
The provider is entitled to amend these Terms, for example in the event of changes in law, case law, or the range of services. We will inform registered users of changes in good time by email. The amended Terms take effect once the user consents to them (e.g. by an explicit confirmation at next login). Consent is not given by mere silence or continued use.
If a user does not consent to the amended Terms, they may delete their account free of charge at any time; a talk+ subscription already paid for continues until the end of the current billing period in that case. Where an amended provision is strictly necessary for continued operation, the provider may suspend use of the affected feature until consent is given.
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. As a consumer, you nonetheless enjoy the protection of the mandatory provisions of the country in which you are habitually resident. Jurisdiction follows the statutory rules: we may, in principle, only sue you at your place of residence, while you may bring claims against us either at your place of residence or at our registered office.
